In a study of nearly 30,000 Americans published in the August 2009 issue of the Journal of the American Dietetic Association, researchers report that race/ethnicity, family income and educational status are independently associated with intake of added sugars. Groups with low income and education are particularly vulnerable to eating diets with high added sugars.

Washington Times Opinion Piece, Editorial Discuss DOJ Nominee Johnsen
The Washington Times recently published an opinion piece and an editorial discussing President Obama"s nomination of Indiana University law professor Dawn Johnsen to head the Office of Legal Counsel in the Justice Department. Summaries appear below. ~ Mickey Edwards/William Sessions, Washington Times: The Senate should "act expeditiously to approve" Johnsen"s nomination because "her views on the limits of presidential power are precisely what the Constitution envisions and conservatives have long championed," Edwards, vice president of the Aspen Institute and author of "Reclaiming Conservatism," and Sessions, a partner at the law firm Holland & Knight, write in a Times opinion piece. According to the authors, Johnsen "made her views clear" on the limits of presidential power when she joined a bipartisan group of lawyers that declared that the Office of Legal Counsel should promote "presidential adherence to the rule of law." Edwards and Sessions write that Johnsen is being criticized for "being blunt, unserious and critical of presidential policies." However, these attacks are unwarranted, they write, noting that in the legal profession, "a little blunt talk to a client -- in this case, the president of the United States -- might be required." Edwards and Sessions continue, "What is needed in the Office of Legal Counsel is a person with the constitutional understanding to know that even presidents with whose politics she agrees must obey both the Constitution and federal statutes and who has the gumption to say so, even if the advice won"t be well received" (Edwards/Sessions, Washington Times, 5/21).~ Washington Times: The editorial states that Johnsen "is so radical" that 31 Republican Indiana state senators on Monday sent a letter to Sens. Evan Bayh (D-Ind.) and Dick Lugar (R-Ind.) asking them to oppose her confirmation. The Republican senators called Johnsen"s views supporting abortion rights "extremely radical" and said she often uses "harsh, sensationalizing rhetoric" in her writings on Supreme Court cases, the editorial states. According to the editorial, Johnsen"s "political advocacy shows a profound disregard for the courts" proper role" because she considers the courts "as making up just another political, policymaking branch of government, not as bodies restrained by the Constitution or existing laws." The editorial continues that Johnsen is "guilty" of "asking judges to impose their own policy preferences" in favor of abortion rights "against the dictates of existing constitutional law." The editorial concludes, "Someone with such contemptuous views of the Constitution should not be the Obama administration"s chief constitutional interpreter" (Washington Times, 5/21).

Appeals Court Upholds Massachusetts Law Establishing Protest-Free Zone Around Abortion Clinics
The U.S. Court of Appeals for the 1st Circuit on Wednesday ruled that a 2007 Massachusetts law requiring antiabortion-rights protesters to stay at least 35 feet away from clinic entrances does not infringe on their free speech rights, the Boston Globe reports. The law updated a 2000 statute that established a floating buffer zone, which police and clinics said was difficult to enforce. The 2007 law set a fixed 35-foot buffer zone around any reproductive health care facility and barred anyone from entering or remaining in the zone unless they work at the clinic; are entering or leaving the facility; are public safety or other municipal officials; or are walking by. Five abortion-rights opponents filed the lawsuit in January 2008. U.S. District Judge Joseph Tauro rejected their claims in August 2008, ruling that the law did not regulate speech -- only the location where the speech could occur -- and that it was drafted in response to safety and law enforcement concerns. The protesters appealed the ruling.The appeals court said that the 2007 law responded to "repeated incidents involving violence and other unduly aggressive behaviors in the vicinity of reproductive health care facilities" and "represents a permissible response by the Massachusetts Legislature to what it reasonably perceived as a significant threat to public safety." The court also said that the law was "content-neutral," as it applies to all protesters regardless of their viewpoints. According to the court, the plaintiffs argued in their appeal that the law had a "content-neutral patina" masking a "more sinister reality" that the Legislature"s true motive was to curb abortion-rights opponents" speech.Massachusetts Attorney General Martha Coakley (D) in a statement said that she was "pleased that the 1st Circuit has upheld this important law, which enhances public safety and access to medical facilities, while preserving the right to engage in expressive activity on public ways and sidewalks near clinics." Tim Chandler, legal counsel for the Alliance Defense Fund, which helped represent the plaintiffs, said abortion-rights opponents "shouldn"t be penalized for expressing their beliefs." He added that the fund and its supporters were evaluating the "next legal step" (Finucane, Boston Globe, 7/10).

Keep Summer Swimming And Stamina Events Safe

Whether having fun, staying in shape or pushing your physical capacity to the extreme, the summer is a great time to enjoy your physical health and move more. Swimming and training for or participating in a marathon or triathalon can be rewarding activities -- and can stay fun with the proper preparation and form. The American Academy of Orthopaedic Surgeons (AAOS) offers summer athletes the following safety tips. Swimming Swimming is a great form of exercise and an even better way to cool off on those hot, summer days. It builds endurance and muscle strength, too. -- The most common swimming injury is shoulder pain due to repetitive motion. The best way to prevent this is with a general exercise program to strengthen the muscles around the shoulder and upper back. -- If diving off a cliff or other high point, make sure the bottom of the body of water is double the distance from which you"re diving. For example, if you plan to dive from eight feet above the water, make sure the bottom of the body of water, or any rocks, boulders or other impediments are at least 16 feet under water. -- Only one person at a time should stand on a diving board. Dive only off the end of the board and do not run on the board. Do not try to dive far out or bounce more than once. Swim away from the board immediately afterward to make room for the next diver. -- Refrain from body surfing near the shore since this activity results in many cervical spine injuries, some with quadriplegia, as well as shoulder dislocations and humeral fractures. Extreme Sport Training A recent study surveyed participants in a major city"s marathon asking them if they sustained injuries during their training process. Fifty-eight percent reported they had been injured during this process, most of them reporting injuries to the knee, hip, ankle, shins or foot. -- Plan a progressive training program to prevent injuries. A five-minute warm-up (which should raise your temperature by one degree) followed by stretching exercises, is essential before starting a distance session. Following the workout, stretching again is important. -- Run, bike or swim in the shade, if possible, to avoid direct sun and make a conscious commitment to staying hydrated. -- Do not run or bike at night, and at dusk or dawn wear reflective material. Don"t wear a headset while training as you"ll be less likely to notice safety threats. -- Avoid running on hills, which increases stress on the ankle and foot. When running on curved surfaces, change directions in forward movement, so that you have even pressure on both feet during the run. -- Always wear a helmet when biking and consider wearing knee, wrist and elbow pads to protect bones and joints when falling. -- Cross training can provide a "total body tune-up," something you won"t get if you concentrate on just one type of activity.
